We care about the privacy of our clients, contractors, business partners, and visitors to our website. Below, we explain which personal data we process, for what purposes and on what legal grounds, who we may share it with, how long we store it, and what rights the data subjects have.

Information on the processing of personal data

This information has been prepared in accordance with Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, hereinafter referred to as the "GDPR".

1. Data controller

2. Who the processed data concerns

We process personal data, in particular, of:

  • customers and contractors who are natural persons, including sole traders,

  • persons representing customers, contractors, and business partners,

  • attorneys-in-fact and employees authorised to act on behalf of the company,

  • contact persons designated for handling orders, invoices, and deliveries,

  • persons interested in the Bergmen offer,

  • persons contacting us via the website, forms, email, telephone, chat, or social media,

  • subscribers to our newsletter and other voluntarily requested commercial information.

Our forms and business services are not directed at children. We do not knowingly collect children's data. If, exceptionally, a consent-based electronic service were to be offered directly to a person under the age of 16, consent should be given or authorised by their parent or legal guardian.

3. What data we process

Depending on the type of relationship and the method of contact, we may process:

  • first and last name,

  • job title or role performed within the company,

  • business or designated email address,

  • phone number,

  • company name, NIP or VAT number, and business registration details,

  • registered office address, correspondence address, and delivery address,

  • contact person details for delivery,

  • information related to orders, deliveries, payments, invoices, complaints, and cooperation history,

  • correspondence content and information provided during contact with Bergmen,

  • information regarding the acceptance of the General Terms and Conditions of Sale, including the document version, the content of statements, and the date and method of their submission and confirmation,

  • responses regarding how you found out about Bergmen and the factors influencing the choice of our offer,

  • information about assignment to customer groups or segments, created based on needs, cooperation history, interest in the offer, or survey responses,

  • technical data related to the use of the website and forms, such as the date and time of the event, IP address, device or browser type, website address, and technical identifiers - if their processing is necessary and complies with the user's consent settings.

We do not request the provision of special categories of personal data, such as information regarding health, origin, opinions, beliefs, trade union membership, genetic or biometric data, or data concerning sex life or sexual orientation.

4. Where we obtain data from

We may receive data:

  • directly from the individual concerned,

  • from the company represented by the individual or for which they perform duties,

  • from the person completing the contractor form or placing an order, if they designate another person for contact, delivery, invoicing, or order fulfilment,

  • from publicly accessible business registers, such as CEIDG, KRS, the register of VAT taxpayers, or VIES,

  • from correspondence conducted with us and the history of cooperation,

  • from analytical tools and cookies - to the extent compliant with the consents granted and privacy settings.

If the contact person's data has been provided by another person, we only process the information necessary to achieve a specific purpose, e.g. delivery or contact regarding the order. Information about the data processing is provided to such a person at the latest during the first contact, unless they already possess this information or another exception under Article 14 GDPR applies.

5. Purposes and legal bases of processing

● Creating a business partner account and starting cooperation:

We process data for the purpose of verifying the company, creating a partner account, taking action prior to entering into a contract, and preparing the cooperation:

  • based on Art. 6(1)(b) GDPR — if the data subject is a party to the contract or takes action prior to entering into it,

  • based on Art. 6(1)(f) GDPR — if the person acts on behalf of a company; our legitimate interest is to establish and manage a business relationship with the represented entity.

● Order processing and cooperation:

We process data in order to accept and complete orders, for sales and technical contact, preparation of quotations, organisation of deliveries, invoicing, payment processing, and ongoing cooperation. The basis is Art. 6(1)(b), (c) or (f) GDPR - depending on whether the person is a party to the contract, represents the partner, or the processing results from a legal obligation.

● Invoices, accounting and legal obligations:

We process data for the purpose of issuing and storing sales documents, maintaining accounts, fulfilling tax and accounting obligations, and using the National e-Invoicing System. The basis is Art. 6(1)(c) GDPR.

● General Terms and Conditions of Sale:

We process data in order to provide the General Terms and Conditions of Sale, record and confirm the declarations made, identify the person acting on behalf of the partner, and verify the version of the document in force at the time of acceptance. The basis is Art. 6(1)(b) and (f) GDPR. Our legitimate interest is the correct structuring of cooperation, ensuring legal certainty of transactions, as well as the establishment, exercise and defence of claims.

● Deliveries and operational contact:

We process the data of persons designated for contact upon delivery in order to organise the dispatch, hand over the shipment, contact the recipient, and resolve any delivery issues. The basis is Art. 6(1)(b) or (f) GDPR. Our legitimate interest is the efficient and correct execution of the order.

● Complaints, claims and transactional security:

We process data for the purpose of handling complaints, settling disputes, preventing fraud, and establishing, exercising and defending claims. The basis is Art. 6(1)(c) or (f) GDPR.

● Marketing research, surveys and analysis:

The answers provided in the partner form regarding how you learned about Bergmen and the factors influencing the choice of our offer are used by us for:

  • measuring the effectiveness of marketing and sales channels,

  • understanding customer needs and motivations,

  • improving products, the offer, customer service and communication,

  • creating aggregate analyses and statistics.

The basis for processing is Art. 6(1)(f) GDPR. Our legitimate interest is to develop our business, evaluate the effectiveness of our activities, and adapt our range of products to market needs. Providing a substantive response is a condition for concluding the contract.

If we organise other surveys or research, information on their purpose, voluntary nature, and any additional rules is provided with the specific survey.

● Direct marketing, segmentation and profiling

We may analyse information about your needs, interest in the offer, history of cooperation, transactions, and survey responses, and on this basis assign individuals or companies to specific target groups. This serves to better adapt Bergmen's range of products, content, service, and marketing activities, as well as to conduct statistical measurements.

Such activities may constitute profiling within the meaning of the GDPR. Their legal basis is Art. 6(1)(f) GDPR, and our legitimate interest is the marketing of our own products and services, understanding customer needs, and assessing the effectiveness of sales and marketing activities. Every individual has the right to object at any time to the processing of their data for direct marketing purposes.

The profiling described above does not lead to decision-making based solely on automated processing which would produce legal effects or similarly significantly affect a specific individual.

● Newsletter and commercial information

If voluntary consent has been given, we process the provided email address for the purpose of sending the newsletter as well as commercial and marketing information regarding Bergmen's products, services, and activities. The legal basis for processing data is Art. 6(1)(a) GDPR, and the sending of electronic communications is based on the prior consent required by the Electronic Communications Law.

Consent can be withdrawn at any time by using the opt-out link in the message or by contacting us. Withdrawal of consent does not affect the lawfulness of activities carried out before its withdrawal and has no effect on the possibility of using the offer or cooperating with Bergmen.

If the communication concerns the products or services of other entities, it will be conducted only after obtaining separate consent, provided that such consent is required by applicable law.

● Contact and correspondence

We process data in order to respond, maintain correspondence, handle inquiries, and retain contact history. The basis is Art. 6(1)(b) or (f) GDPR.

● Website, statistics and security

Technical data may be processed to ensure website functionality and security, prevent abuse, compile basic statistics and — after obtaining the required consent — analyse traffic and conduct marketing activities. Details regarding cookies and the option to change consents are available in the privacy settings on the website.

6. Is providing the data mandatory?

Providing the data marked as mandatory in the forms is necessary to achieve the purpose indicated in the given form, e.g., creating a contractor account, confirming the General Terms of Sale (OWS), issuing documents, or organising delivery. Failure to provide this data may prevent the completion of the specified activity.

Providing data for the newsletter and granting marketing consent is completely voluntary. Responses in the research section are a prerequisite for cooperation.

7. Data recipients

Data may be transferred only to the extent necessary to achieve a specific purpose:

  • to Bergmen employees and associates holding appropriate authorisations,

  • to providers of hosting, website maintenance, online forms, and IT services,

  • to providers of CRM systems, databases, process automation, and integration,

  • to providers of email, cloud services, newsletter systems, and customer communication,

  • to providers of analytical tools - within the scope resulting from consent settings,

  • to accounting offices, accounting system providers, banks, and payment operators,

  • to carriers, courier companies, logistics and warehouse operators,

  • to law firms, advisors, auditors, and insurers,

  • to public authorities or other authorised entities, if the obligation to transfer data arises from the law.

Entities processing data on our behalf act on the basis of agreements and may use the data only in accordance with our instructions and applicable regulations.

8. Transfer of data outside the European Economic Area

Some technology service providers may process data outside the European Economic Area. If such a transfer takes place, we apply the mechanisms required by the GDPR, in particular European Commission adequacy decisions, standard contractual clauses or other legally permissible safeguards.

9. How long we store the data

The storage period depends on the purpose and the legal basis of processing:

  • data related to the contractor's account, contracts and orders - for the duration of the cooperation, and then until the expiry of the relevant limitation periods for claims,

  • accounting, tax and billing documents - for the period required by law,

  • information regarding the sharing and acceptance of the GTCS - for the duration of the cooperation and the time necessary to establish, assert or defend against claims,

  • contact persons' data - for the period in which they perform a given role or are needed to carry out cooperation, orders or deliveries,

  • correspondence and enquiries - for the period necessary to handle the matter, and subsequently for a period justified by the possibility of asserting claims or the need to maintain cooperation history,

  • individual research responses - for the time needed to perform analyses and evaluate their results, no longer than justified by the purpose, and then, where possible, in an aggregated or anonymised form,

  • data used for self-marketing, segmentation and profiling - until an effective objection is made, the legitimate interest ceases, or the expiry of the utility period of the data for the given purpose,

  • newsletter data - until consent is withdrawn or the newsletter is discontinued; information about granting and withdrawing consent may be stored longer to demonstrate compliance with the law,

  • data processed on the basis of a legitimate interest - until an effective objection is made or this interest ceases,

  • data from cookies and analytical tools - for the period resulting from the type of the given file or the settings specified in the consent panel.

After the expiry of the relevant period, we delete the data, anonymise it or restrict its further processing if the obligation to retain it arises from statutory provisions.

10. Automated Decisions and Profiling

In connection with the client record, we do not make decisions regarding individuals based solely on automated processing that would produce legal effects or similarly significantly affect them.

Responses concerning the sources of customer acquisition and reasons for choosing the offer may be grouped and analysed statistically. They are not used for automated refusal of cooperation, setting individual prices, or making other decisions that produce significant effects on a specific individual.

If the method of using data in this respect changes in the future, we will update this information before commencing the new type of processing.

11. Rights of data subjects

Under the terms set out in the GDPR, you have the right to:

  • access your data and receive a copy of it,

  • rectify incorrect data or complete incomplete data,

  • erase data,

  • restrict processing,

  • data portability - if the processing is based on consent or a contract and is carried out by automated means,

  • object to processing based on Article 6(1)(f) of the GDPR, including marketing analysis, due to the specific situation of the individual,

  • object to direct marketing at any time,

  • not be subject to a decision based solely on automated processing, including profiling, if it produces legal effects or similarly significantly affects the individual, subject to the exceptions provided for in the GDPR,

  • withdraw consent at any time, if the processing is based on consent,

  • lodge a complaint with the President of the Personal Data Protection Office.

A request regarding the exercise of your rights can be sent to kontakt@bergmen.pl or by post to the registered office address of Bergmen. In order to protect your data, we may request information necessary to confirm the identity of the person making the request.

The exercise of rights is, in principle, free of charge. In cases provided for by the GDPR, in particular when the request is manifestly unfounded or excessive, we may charge a reasonable fee or refuse to take action, stating the reason for such a decision.

12. Data security

We apply technical and organisational measures appropriate to the risks associated with data processing. These include, in particular, access management, restriction of privileges, system security, backups, protection of data transmission, and requiring appropriate safeguards from suppliers processing data on our behalf.

13. Changes to information

We may update this information due to changes in regulations, the website operation, forms, systems used, or business processes. The current version is published on this page along with its effective date.

Significant changes regarding how we process the data of individuals with whom we have a relationship may also be communicated through another appropriate channel, e.g. by e-mail.
