Information about GDPR
Information on the processing of personal data
In accordance with Article 13, paragraphs 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter 'GDPR'), we want to explain:
What personal data we collect and process if you are our client, contractor or business partner,
The purposes, reasons, and duration for which we use personal data,
How we protect the security of personal data,
How we implement your right to data protection.
All personal data is collected and processed in accordance with the data protection legislation in force in Poland and the European Union.
Providing personal data is voluntary but is a necessary condition for taking advantage of the offers of Bergmen Sp. z o.o. based in Skawina and is essential for the conclusion and performance of the contract.

What data we collect:
Personal data refers to any information about you that enables identification, such as your name and contact details. We may collect your personal data when you use our website, utilise our services, participate in a survey, competition, or simply get in touch with us. We may specifically collect information belonging to the following categories:
name and surname, home address, email address, phone number;
information regarding your registration data if you run a business (e.g., NIP, REGON numbers, business address);
information regarding your transaction history,
information regarding the use of our website;
communication with you or directed to us by you via mail, email, chat, social media, and by phone.
We assure you that we do not require data concerning suspected crime or conviction. We also do not collect data regarding your ethnic or racial origin, political opinions, religious or philosophical beliefs, trade union membership, genetic and biometric data, sexuality, or sexual orientation.
We never ask for this information, nor do we collect or process it unless you deliberately provide it to us, for example, in an email.
Purpose of data processing:
Your data may be used for the following purposes:
the conclusion and performance of contracts (based on Article 6(1)(b) of the GDPR),
undertaking actions at the request of the data subject before entering into a contract (based on Article 6(1)(b) of the GDPR),
enabling customers, contractors, and collaborators to use services provided by Bergmen Sp. z o.o. based in Skawina (based on Article 6(1)(b) of the GDPR),
conducting financial settlements (based on Article 6(1)(b) of the GDPR),
responding to complaints and conducting the complaint procedure (based on Article 6(1)(c) of the GDPR),
evidential purposes, by pursuing a legitimate interest of the Controller, to secure information for proving facts in potential legal disputes (based on Article 6(1)(f) of the GDPR),
tailoring the provided services to the needs of customers, contractors, collaborators, i.e., profiling (based on Article 6(1)(f) of the GDPR),
marketing purposes, including statistical measurements, analysis, and profiling of personal data for marketing purposes related to the Controller's services (based on Article 6(1)(f) of the GDPR),
marketing purposes, including analysis and profiling of personal data for marketing purposes related to third-party services (based on Article 6(1)(a) of the GDPR),
other purposes necessary for fulfilling a legal obligation imposed on the Controller (based on Article 6(1)(c) of the GDPR).
We will process your personal data only when we have a legal basis to do so. The legal basis will depend on the reasons for which we have collected your personal data and the purpose for which we intend to use it.
In most cases, processing personal data will be necessary for us to enter into a contract with you.
We may also process personal data in the following cases:
To comply with a legal obligation (e.g., maintaining financial or accounting records);
When you have given consent for the use of your personal data (e.g., for marketing purposes);
To protect the vital interests of the user or another person (e.g., in medical emergencies);
For purposes related to our legitimate interests as a business (e.g., for administrative purposes).
Consent can only be given by individuals who are at least 16 years old.
For children under 16 years, parental or legal guardian consent is required.
Personal data is stored and processed for the periods necessary for Bergmen Sp. z o.o. in Skawina to perform the contract and achieve other purposes detailed in the content of this document.
Bergmen Sp. z o.o. based in Skawina reserves the right to archive the provided personal data for evidential purposes in order to defend against potential claims that may arise based on the contracts concluded, which is the fulfilment of a legitimate interest of the Controller, based on Article 6(1)(f) of the GDPR, and for purposes necessary to fulfil a legal obligation imposed on the Controller, based on Article 6(1)(c) of the GDPR. The archived data is stored for the period of limitation of mutual claims or required by binding legal regulations, particularly tax law, whichever of these periods is longer.
The period of storing and processing personal data for marketing purposes lasts until an effective objection is raised or until the consent is withdrawn.
When your personal data is no longer needed, it will be securely deleted or destroyed.
Data Security
We adhere to strict safety procedures regarding the storage and disclosure of personal data, which also aim to protect data from accidental loss, destruction, or damage. We may disclose information about you to trusted individuals, from whom we require appropriate technical and organisational safeguards to protect the user's personal data in accordance with Polish and EU personal data protection law.
The recipients of personal data may include:
Individuals authorised by the Administrator to process personal data in the course of performing their duties.
Entities to whom the Administrator entrusts the performance of tasks that require data processing (data processors),
Other recipients, e.g. couriers, banks, insurers, legal offices
Personal data may only be shared with data recipients for the purposes specified in this document.
Personal data will not be transferred to a third country.
The Administrator processes data solely for the purposes specified in this document. If it becomes necessary to process personal data for purposes not disclosed in this document, the Administrator will ask the data subject for consent for the specific processing before commencing such processing.
Your rights
You have the right to:
Request information about whether your personal data is being stored and, if so, what data is stored and for what purpose we store/use it.
Request access to your personal data, which allows you to obtain a copy of the personal data we hold about you and to verify that we are processing it lawfully.
Request correction of the personal data we hold about you. You may complete any incomplete data or correct any inaccurate information about you that we have stored.
Request the deletion of personal data where there is no compelling reason for its continued processing.
Object to the processing of personal data where we are relying on a legitimate interest (or that of a third party) and there is something specific about your situation that makes you want to object to processing on this ground. You also have the right to object where we are processing your personal data for direct marketing purposes.
Object to automated decision-making, including profiling, i.e., object to automated decision-making about you using your personal data or to profiling you.
Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data, for example, if you want us to establish its accuracy or the reason for processing it.
Request the transfer of your personal data in an electronic and structured format to you or another person (known as the right to "data portability"). This enables you to obtain your data in a format that facilitates the electronic use and transfer of your data to another person in a format suitable for electronic use. This, of course, requires our technical capabilities and the cooperation of the other entity.
Withdraw consent. In limited circumstances, if you have given consent to collect, process, and transfer your personal data for a specific purpose, you have the right to withdraw consent for that processing at any time. Once we have received notification of withdrawal of consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another legitimate interest in such processing.
Lodge a complaint with the Personal Data Protection Office against the Administrator's action contrary to the law.

We do not charge a fee for access to your personal data (or for exercising other rights to which you are entitled). However, we may charge a reasonable fee if the access request is clearly unfounded or excessive in scope.
In such circumstances, we may also object to such a request.
The Administrator informs you that the withdrawal of consent to the processing of personal data does not affect the legality of data processing based on consent obtained before its withdrawal.
In certain cases, we may need to request specific information from you to confirm your identity and ensure your right to access information (or to exercise any of your other rights). This is another security measure to ensure that personal information is not disclosed to any person who has no right to receive it.
