Information on the processing of personal data

Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter the “GDPR”), we hereby inform you that in this document we would like to explain:

  • What personal data we collect and process if you are our customer, contractor or business partner,

  • For what purposes, on what grounds and for how long we use personal data,

  • How we protect the security of personal data,

  • How we implement your right to data protection.

All personal data is collected and processed in accordance with personal data protection legislation in force in Poland and the European Union.

Providing personal data is voluntary; however, it is a prerequisite for using the offers of Bergmen Sp. z o.o., with its registered office in Skawina, and is necessary for the conclusion and performance of a contract.

What data we collect:

Personal data means any information about you that makes identification possible, for example your full name or contact details. We may collect your personal data when you use our website, use our services, take part in a survey or competition, or simply contact us. In particular, we may collect information falling into the following categories:

  • full name, home address, email address, telephone number;

  • information about your registration details if you run a business (e.g. NIP and REGON numbers, business address);

  • information about your transaction history,

  • information about your use of our website;

  • communications with you or sent to us by you via post, email, chat, social media, and by telephone.

We confirm that we do not need data concerning suspected criminal offences or convictions. We also do not collect data concerning your ethnic or racial origin, political opinions, religious or philosophical beliefs, trade union membership, genetic and biometric data, sexuality, or sexual orientation.

We never ask for this information and do not collect or process such data unless you intentionally provide it to us, for example in an email.

Purpose of data processing:

Your data may be used for the following purposes:

  • concluding and performing contracts (pursuant to Article 6(1)(b) GDPR),

  • taking action at the request of the data subject prior to entering into a contract (pursuant to Article 6(1)(b) GDPR,

  • enabling clients, contractors and associates to use the services provided by Bergmen Sp. z o.o., with its registered office in Skawina (pursuant to Article 6(1)(b) GDPR),

  • making financial settlements (pursuant to Article 6(1)(b) GDPR),

  • responding to complaints and conducting the complaint procedure (pursuant to Article 6  (1)(c) GDPR),

  • evidential purposes, through the implementation of the legitimate interest pursued by the Controller, in order to secure information for demonstrating facts in potential legal disputes (pursuant to Article 6(1)(f) GDPR),

  • adapting provided services to the needs of clients, contractors and associates, i.e. profiling (pursuant to Article 6(1)(f) GDPR),

  • marketing purposes, including statistical measurements, analysis and profiling of personal data for marketing purposes related to the Controller's services (pursuant to Article 6(1)(f) GDPR),

  • marketing purposes, including analysis and profiling of personal data for marketing purposes related to third-party services (pursuant to Article 6(1)(a) GDPR),

  • other purposes necessary to fulfil a legal obligation incumbent on the Controller (pursuant to Article 6(1)(c) GDPR).

We will process your personal data only when we have a legal basis to do so. The legal basis will depend on the reasons for which we collected your personal data and the purpose for which we are to use it.

In most cases, personal data processing will be necessary for us to conclude a contract with you.

We may also process personal data in the following cases:

  • To fulfil a statutory obligation (e.g. by keeping accounting or bookkeeping records);

  • When you consent to the use of your personal data (e.g. for marketing purposes);

  • To protect the vital interests of the user or another person (e.g. in medical emergencies);

  • For purposes related to our legitimate interests as a business (e.g. for administrative purposes).

Only persons aged at least 16 may give consent on their own behalf.
For children under 16 years of age, consent from parents or legal guardians is required.

Personal data is stored and processed for periods necessary for the performance of the contract by Bergmen Sp. z o.o. in Skawina and for the achievement of other purposes specified in detail in this document.
Bergmen Sp. z o.o., with its registered office in Skawina, reserves the right to archive the personal data provided for evidential proceedings for the purpose of defending against potential claims that may arise from concluded contracts, constituting the implementation of the Controller's legitimate interest, pursuant to Article 6(1)(f) GDPR, as well as for purposes necessary to fulfil a legal obligation incumbent on the Controller, pursuant to Article 6(1)(c) GDPR. Archived data is stored for the limitation period for mutual claims or for the period required by binding legal provisions, in particular tax law, depending on which of these periods is longer.

The period for storing and processing personal data for marketing purposes lasts until an effective objection is raised or until consent is withdrawn.

When your personal data is no longer needed, it will be securely deleted or destroyed.

Data Security

We adhere to strict security procedures for the storage and disclosure of personal data, also aimed at protecting data against accidental loss, destruction or damage. We may disclose your information to trusted parties from whom we require appropriate technical and organisational safeguards to protect users’ personal data in accordance with Polish and EU personal data protection law.

Recipients of personal data may include:

  • Persons authorised by the Controller to process personal data as part of performing their duties.

  • Entities commissioned by the Controller to carry out activities that require data processing (processors),

  • Other recipients, e.g. couriers, banks, insurers, legal practices

Personal data may be made available to data recipients only for the purposes indicated in this document.

Personal data will not be transferred to a third country.

The Controller processes data only for the purposes specified in this document. If it is necessary to process personal data for purposes not disclosed in this document, the Controller will, before starting such processing, ask the data subject to give consent to the specific processing.

Your rights

You have the right to:

  • Request information on whether your personal data is stored and, if so, what data is stored and for what purpose we store/use it.

  • Request access to your personal data, under which you can obtain a copy of the personal data we hold about you and verify whether we process it lawfully.

  • Request rectification of the personal data we store about you. You may complete any incomplete data or correct inaccurate information concerning you that we store.

  • Request erasure of personal data where there are no grounds justifying its further processing.

  • Object to the processing of personal data where we process it on the basis of our legitimate interest (or that of a third party), and your particular situation gives rise to any reason for you to object to processing on this basis. In addition, you have the right to object where we process your personal data for direct marketing purposes.

  • Object to automated decision-making, including profiling, i.e. object to automated decisions concerning you made using your personal data or object to profiling.

  • Request restriction of the processing of personal data. You may request suspension of the processing of your personal data, for example where you want us to establish its accuracy or the reason for its processing.

  • Request transfer of personal data in electronic and structured form to you or to another person (the so-called right to “data portability”). This enables you to receive data from us in a format that allows it to be used electronically and to transfer your data to another person in a format that allows electronic use. This, of course, requires our technical capabilities and the cooperation of the other entity.

  • Withdraw consent. In limited circumstances, where you have consented to the collection, processing and transfer of personal data for a specific purpose, you have the right to withdraw consent to such processing at any time. Once we receive notice that consent has been withdrawn, we will stop processing the data for the purpose or purposes to which you originally consented, unless we have another legally justified interest related to such processing.

  • Lodge a complaint with the Personal Data Protection Office regarding actions of the Controller that are contrary to the law.

We do not charge a fee for access to personal data (or for exercising any other applicable rights). However, we may charge an appropriate fee if a request for access is clearly unfounded or excessive in scope.

In such circumstances, we may also refuse such a request.

The Controller informs that withdrawal of consent to the processing of personal data does not affect the lawfulness of personal data processing carried out on the basis of consent obtained before its withdrawal.

In certain cases, we may need to ask you for specific information to confirm your identity and ensure your right of access to information (or to exercise any other right to which you are entitled). This is an additional security measure to ensure that personal data is not disclosed to unauthorised persons.
